COVERAGE
The Underwriter hereby agrees to indemnify the Insured or on behalf of the Insured subject to the Provisions, Exclusions and Definitions contained herein, up to the sum insured stated in the Schedule of Benefits for Accidental Damage or Loss of Equipment sustained whilst the Insured is engaged in Scuba Diving or whilst the equipment is in storage. The Underwriter will also pay up to the sum insured shown in the event of EmergencyJettison of Equipment whilst in use.
DEFINITIONS
1. The Underwriters who have insured you, the insured, under this risk
2. Authoritative Diving Bodies means recognised national controlling organisations, or organizations affiliated to R.S.T.C. or C.M.A.S who provide guidelines and recommendations to their membership for safe diving practices.
3. R.S.T.C means the Recreational Scuba Training Centre.
4. C.M.A.S means the Confederation Mondiale des Activities Scubaquatiques.
5. Claims Administrator means the designated claims administrator (Cox Claims Management, Swansea ).
6. Insured means the individual who has proposed insurance to the Underwriters.
7. Assistance Company means the agent (Sheraton Services Limited) of the Underwriters authorised to assist the Insured as a result of Accidental Damage or Loss to diving Equipment.
8. Scuba Diving means recreational snorkelling and/or diving using standard manufacturers diving Equipment when the Insured is wholly or partially immersed in water.
9. Equipment means all items used in connection with Scuba Diving and listed on the schedule. To include air tanks, wet suits, specialised diving watches and computers, snorkels, masks, flippers and other diving effects listed on the schedule of insurance.
10. Accidental Damage means damage caused as a direct result of a single unexpected event.
11. Storage as follows:
- Storage whilst in your private living accommodation, or a locked cupboard within a locked garage.
- Storage within your secure holiday accommodation.
SCHEDULE OF COVER
The Underwriters will pay up to the limits set against each section with the level of cover selected by you being indicated in the accompanying policy schedule. However, the maximum recoverable amount under this policy in the aggregate shall not exceed.

PROVISIONS
Provided always that:
1. The Scuba Diving is carried out in accordance with the guidelines and recommendations for safe diving practices as established by the Authoritative Diving Bodies.
2. No costs shall be incurred or payments made without the consent of the Underwriters or their designated Claims Administrator.
3. The Equipment must be maintained in a serviceable condition to accepted driving standards.
4. Any wristwatch must be worn on the wrist with a covering watchstrap to retain the watch in the event that the strap or strap pins break or fail during Scuba Diving.
5. Camera equipment or other loose items must be attached securely to the insured whilst diving.
CONDITIONS
The following conditions apply in order to make the contract of insurance legitimate. Provided it is the sole property of the Insured, or hired by the Insured, the Underwriters will cover Accidental Damage to diving Equipment plus theft, and loss of diving Equipment. Cover is only provided during Scuba Diving, whilst in transit, whilst out of sight in a locked vehicle, or when kept in a locked place of storage. The maximum single article limit for any one item is £200 unless it is declared on the schedule. Underwriters must be notified of any new items purchased by the Insured in writing for changes to be made to the schedules before cover extends to the additional/replacement item/s. Claim settlement shall be based on replacement value subject to the correct premium having been paid and not to exceed the total sum insured. The principle of average shall be applied in the event of any under insurance. The right to replace, reinstate or repair lost, damaged or stolen items is held by the Underwriters. The decision as to whether Equipment is deemed to be a “write off” is held by the Underwriters. All equipment written off becomes the sole property of the Underwriters for their disposal in any manner they see fit It is expected that the Insured consents to produce originals of qualification records, medical certificates and/or reports, personal log books, Dive Log Sheets, Dive Marshals and Dive Officers names and addresses upon request by the Underwriters.
CAMERA AND VIDEO EQUIPMENT CLAUSE
It is herby noted and agreed that in consideration of the premium paid, the list of underwater photographic and video equipment captioned on the camera and video equipment section of this proposal form is covered by the full benefit of this certificate. Additionally the damaged unit must be submitted to a recognised service agent of the manufacturer for repair as soon as practically possible.
HIRE EQUIPMENT ENDORSEMENT
This policy provides cover up to £25 per day (£200 in total) for the cost of hiring diving equipment, if as a result of a covered loss under this Insurance you are required to hire replacement diving equipment in order to attend a dive training course or dive holiday that was pre booked and pre paid to the loss occurring.
EXCLUSION
The insurance does not provide coverage for any Loss or Accidental Damage resulting directly or indirectly from:
1. Theft where there is no physical evidence of forcible or violent entry into or exit from a locked room or cupboard.
2. Theft from an unattended vehicle unless kept out of sight in a locked boot or glove compartment where there are signs of forcible or violent entry.
3. Any personal injury to the Insured as a result of Scuba Diving and/or the carrying/moving of equipment.
4. Any claim where a completed claim form is not submitted within 30 days of the date of the claim arising.
5. Any claim for theft or loss not reported to the police within 24 hours of discovery and a crime reference number obtained.
6. Any claim for Mechanical or Electrical breakdown or derangement.
7. Wear, tear, the effects of salt water and other gradually operating causes including latent defect, inherent fault, faulty workmanship or materials.
8. Any process of servicing, repairing or cleaning, unless carried out by a professional.
9. Confiscation or similar action by order of any Government, Customs or like authorities.
10. Riot or civil commotion outside the United Kingdom .
11. Personal effects and money.
12. Claims in respect of any loss or damage caused by or arising from ionising- radiation or contamination by radioactivity from any nuclear fuel or from any nuclear waste from the combustion of nuclear fuel or from the radioactive toxic explosive or other hazardous properties of any nuclear assembly or nuclear component thereof.
13. Loss or damage caused by wilful misconduct or lack of due diligence by the insured.
14. Legal liability.
15. Loss or damage due to you diving solo, unless in accordance with the recommendations of your certifying association.
16. Excluding photographic and video equipment unless such equipment is declared and identified in the policy schedule.

EXCESSES
This section explains that you are responsible for the first part of each and every claim (the Excess) The Insured shall pay the first amount of each claim in the sum of £35 after any condition of average has been applied.
CLAIMS PROCEDURE
Claims must be notified to Underwriters by written notice within 30 days after a covered loss begins. If you need to make a claim, please telephone Cox Claims Management on: 0870 420 4607. Underwriters will pay for replacement or repair to Equipment immediately after Underwriters receive proof of loss. The Underwriters will decide whether to pay the cost of repairing an item, or replacing it with a new item (in the same form and style) if it is lost or damaged beyond repair.
CANCELLATION
Either party giving 7 days written notice can cancel the policy. Return of premium will be calculated at pro-rata but subject to a maximum return of 50%. The Underwriter may cancel the insurance immediately if the Insured does not pay the appropriate premium.
FINANCIAL SERVICES COMPENSATION SCHEME
Lloyd’s insurers are covered by the Financial Services Compensation Scheme. You may be entitled to compensation from the Scheme if a Lloyd’s insurer is unable to meet its obligation to you under this contract. If you are entitled to compensation under the Scheme, the level and extent of the compensation would depend on the nature of this contract. JURISDICTION
This contract of insurance is subject to English Law and English Courts will deal with disputes arising.
